7) Consider approval of a Resolution ratifying a previously submitted grant application, for which the deadline was September 3, 2026 to the U.S. Department of Justice for the FY 2026 Community Oriented Policing Services (COPS) Safer Outcomes: Enhancing Crisis Response Training for Law Enforcement Program in the amount up to $350,000.00, with no local match required, for an interactive simulating training system. 

8) Consider approval of a Possession and Use Agreement between the City of Kyle, Texas and Rosa Maria Reyes for the possession and use of 1,164 square feet (0.0267 AC) of roadway right of way for the purpose of improvements to the eastern segment of the Bebee Road project for the 2022 Road Bond in the amount of $15,000.00 for independent consideration for the possession and use of the property. 

9) Consider approval of a Resolution authorizing the Interim City Manager to execute all documents necessary to purchase 1,164 SF (0.0267 AC) of right of way from Rosa Maria Reyes, for the purpose of improvements to the eastern segment of the Bebee Road project for the 2022 Road Bond, in an amount of $166,051.00, plus an estimated $2,500.00 for reasonable closing costs.

10) Consider approval of a Possession and Use Agreement between the City of Kyle, Texas and Julio Rochel for the possession and use of 5,587 square feet (0.1282 AC) as roadway right of way and 1,272 square feet (0.0292 AC) as a grading easement for the purpose of improvements to the eastern segment of the Bebee Road project for the 2022 Road Bond in the amount of $5,296.90 for independent consideration for the possession and use of the property. 

11) Consider approval of a Resolution authorizing the Interim City Manager to execute all documents necessary to purchase 5,587 SF (0.1282 AC) of right of way and a 1,272 SF (0.0292 AC) of grading easement from Julio Rochel, for the purpose of improvements to the eastern segment of the Bebee Road project for the 2022 Road Bond in an amount of $65,005.00, plus an estimated $2,000.00 for reasonable closing costs.

12) Consider approval of a Resolution authorizing the Interim City Manager to execute all documents for a relocation assistance payment to Veronica Castillo in an estimated amount of $3,494.00, for three additional months of storage and two additional months of temporary lodging related to the Old Stagecoach Road project of the 2022 Road Bond.

13) Consider approval of a Resolution to appoint Patricia Palacios to Seat 1 to fill a vacancy for an unexpired term, ending September 2027 and Irma Mason to Seat 6 of the Planning & Zoning Commission for a two-year term.

14) Consider approval of a Resolution appointing the Kyle Area Youth Advisory Council (KAYAC) members for the 2026-2027 term.

15) Consider approval of a Resolution accepting Council Member Zapata's resignation from City Council District 3.

16) (First and Final Reading) Consider approval of an Ordinance calling a Special Election for December 12, 2026 to fill a vacancy for an unexpired term in City Council District Three, at-large; Providing for candidate application methods; Designating the main and branch early voting locations for such election; Providing for an Order and Notice of such Special Election; Providing for related matters; Providing a Severability Clause; and Providing an Effective Date.

17) Consider approval or denial of a Resolution regarding an appeal of the Sign Control Board’s decision to deny an exception to the prohibition on LED displays and LED signs (Section 29-17(b)(6)) and the limitation of LED signs to certain properties (Section 29-16(l)), to allow replacement of an existing static pylon sign with an LED message board sign on property located at 18300 IH-35, Kyle, Texas 78640. (VR-26-0018) The Sign Control Board voted 4 to 0 to deny the request on August 24, 2026. 

18) Consider approval of a Resolution designating the reconstruction of Bunton Creek Road as the next highest-priority roadway project under the City's 2022 Road Bond Program, and providing direction regarding the project scope, including: Reviewing the current project status; Reviewing the original project budget and updated cost estimates; Determining the width of pedestrian facilities; Determining whether electrical utilities should be relocated underground or remain overhead; and Authorizing the Interim City Manager to exceed the original project budget by an amount established by the City Council to implement the approved project scope.

18) Consider approval of a Resolution regarding the scope reevaluation of the Center Street on-system and off-system projects included in the 2022 Road Bond Program, including: Selecting either the proposed 12-foot-wide Vybe Trail or a 6-foot-wide sidewalk; Determining whether electrical utilities should be relocated underground or remain overhead; and Authorizing the Interim City Manager to exceed the original budget by an amount established by the City Council to implement the approved project scope.

20) Consider directing the Interim City Manager to bring back a Resolution regarding record-keeping for Executive/Closed Session Council Meetings.

21) Consider approval of a Resolution adopting the staff recommendation to continue with the current program design for the City's Cross Connection Control and Backflow Prevention Program, which requires annual testing of all identified irrigation backflow assemblies.

22) Consider approval of a Resolution authorizing the dates, times, routes, and related details for the City of Kyle Founders Day Parade and Veterans Day Parade.

23) Consider and possible action to approve a Resolution to authorize the Interim City Manager to negotiate and execute an extension of the 2nd Option Fee payment deadline to April 30, 2027 and reassess participation at that time to include the following future Council considerations and action: Discontinuing the City’s participation in the project and: Declining to make the 2nd Option Fee payment of $273,763.00. Terminating the City's Option Contract with the Nueces River Authority. Authorizing the City Attorney to provide notice of termination and pursue  repayment of the Option Fee paid in October 2025.

24) Consider approval of a Resolution directing the Interim City Manager to bring back an agreement ensuring long-term occupancy and/or ownership of the property located at 107 Veterans for VFW Post #12058.

25) Consider approval of a Resolution authorizing a settlement agreement with Christina W. Phillips, as Trustee of the Christina W. Phillips and Andrew W. Phillips Irrevocable Trust, for settlement of Cause No. 25-1290C, City of Kyle, Texas vs. Christina W. Phillips, as Trustee of the Christina W. Phillips and Andrew W. Phillips Irrevocable Trust, et al., in County Court at Law No. 1, Hays County, Texas.

26) Discussion and possible action to direct the Interim City Manager to have the City's Water Utilities Department prepare and present to the City Council, no later than January 2027, a Water Supply Weighted Portfolio Analysis evaluating alternative combinations of water supply strategies and identifying the portfolio mix that best meets the City's long-term water supply objectives. The analysis will evaluate the City's entire water supply portfolio, including surface water, groundwater, reclaimed water, indirect potable reuse (IPR), direct potable reuse (DPR), aquifer storage and recovery, conservation measures, desalination, and other planned water purchases. At a minimum, the weighted analysis shall assess supply reliability, drought resilience, capital investment requirements, regulatory compliance, operational risks, and most importantly, the affordability of potable drinking water for the residents of Kyle.

27) Discussion and possible action on License Plate Readers and next steps.

28) Direct staff to bring back a Resolution of the City of Kyle, Texas to make appointments for one primary and one alternate voting representative to the CAMPO Technical Advisory Committee to replace Mike Trimble.

29) Pursuant to Chapter 551, Texas Government Code, the City Council reserves the right to convene into Executive Session(s) from time to time as deemed necessary during this meeting.  The City Council may convene into Executive Session pursuant to any lawful exception contained in Chapter 551 of the Texas Government Code including any or all of the following topics. Executive session pursuant to Texas Government Code §551.071and Texas Disciplinary Rules 1.05 to: Consult with the City Attorney concerning the counterproposal received from the Municipal Utility District (MUD) petitioners to resolve the water and wastewater rate appeal filed with the Texas Public Utility Commission under Docket No. 58988. Executive session pursuant to Texas Government Code §551.071 and Texas Disciplinary Rules 1.05 and pursuant to Texas Government Code §551.072 to: Consult with the City Attorney concerning legal issues related to the possible purchase, exchange, lease, or value of real estate needed for transportation improvements and related infrastructure, including, but not limited to the City’s road bond projects, specifically properties needed for the Bebee East Project, the Old Stagecoach Road Project, and the Kyle Parkway Road Project; and Consult with the City Attorney concerning legal issues related to the possible purchase, exchange, lease, or value of real estate of property needed for water and wastewater utility infrastructure improvements, specifically related to the Post Oak Waterline Project.  

30) Take action on items discussed in Executive Session.
